General Terms and Conditions
§ 1 Area of Application
(1) The following General Terms and Condition are an integral part of each contract between Anuncios-web (hereinafter referred to as Operator) and the companies and consumers and its/their legal successors which/who trade on the Internet platform (hereinafter referred to as User).
(2) The Operator provides services exclusively on the basis of these General Terms and Conditions.
(3) The effectiveness of these General Terms and Conditions applies to all services offered by the Operator. By using the services of the Operator, the User accepts these General Terms and Conditions as binding.
§ 2 Conclusion of the Agreement
(1) The Agreement in form of an agency agreement becomes effective by the User registering according to the specified electronic procedure providing all the information necessary for the conclusion of the Agreement and the Operator's sending of the registration confirmation by e-mail as subsequent acceptance of the Agreement.
(2) The Operator reserves the right to refuse the registration in individual cases.
§ 3 Contractual Services
(1) The User receives access to the Internet advertising platform with the conclusion of this Agreement. This allows the User to offer goods and services by placing individual ads.
(2) The contractual parties to any contracts concluded through this trade platform are only the Users participating in the conclusion of these contracts. The Operator is not Party to the conclusion of the individual contracts. Accordingly, the contract is executed only in the relation of the corresponding User. Any claims arising under or in connection with the contracts concluded between the Users which are filed against the Operator are excluded.
(3) Placing an ad on the platform of the Operator does not constitute a binding offer.
§ 4 Users' duties and responsibilities
(1) The User must provide the Operator completely and truthfully with all necessary data during the registration. The Operator must be promptly notified of any changes.
(2) The offers of the Users specified in the classified ads and their design must comply with the applicable legal regulations.
(3) The User is solely responsible for all contents the User produced and published contents or all contents produced and published through the User's password identification. A liability becomes effective only if a sole culpability is determined.
(4) The User assures that the User owns all rights to all contents (e.g. texts, images, etc.) which the User publishes online or the Operator publishes online on the User's behalf.
(5) In addition, the User is not permitted to place a link in the User's ad which refers to the User's own or a third party website. This shall not apply to the additional option, which the Operator will provide for a fee and which allows placing a link referring to another link.
(6) If the User that offers goods or services is a company then the User must comply with the legal regulations when entering contracts with consumers, which are specifically the consumer's right of revocation and the duty to respect the price information.
§ 5 Termination
(1) The Agency Agreement between the Operator and the User in accordance with § 2 of these General Terms and Conditions will be concluded for an unspecified time.
(2) Each of the contractual Parties is entitled to terminate this Agreement without maintaining a termination period. In the event that the User has placed an ad subject to a fee at the time of termination then the termination becomes effective after the expiry of this ad.
